President Bush signed The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 on April 20, 2005. The Act effects sweeping change in how individual debtors can obtain relief from consumer debts. This FAQ does not reflect these changes. With a few exceptions, the Act will not affect bankruptcy petitions filed on or before October 14, 2005. Cases filed before then will be filed under the old bankruptcy rules. Cases filed on October 17, 2005, and after, will be subject to the new rules. Because of this, and because of the few exceptions where the Act is now in effect, please do not rely upon the information in this FAQ. It should be used for general guidance only and should not be used as a replacement for competent professional advice.
